Terms of Use of the Point of Single Contact « business.belgium »

Purpose and scope

These Terms of Use govern access to and use of the Belgian Point of Single Contact, known as business.belgium. The business.belgium website is a centralised digital platform made available by the Federal Public Service for Policy and Support (FPS BOSA), Directorate-General for Simplification and Digitalisation, enabling entrepreneurs to consult detailed information relating to administrative procedures, initiate administrative formalities, monitor the progress of procedures and obtain assistance in the context of the creation, modification and/or cessation of a business, as well as the related economic activities.

These Terms of Use apply exclusively to the use of the business.belgium website by Users, excluding dedicated applications that are accessible through the website but are subject to their own terms of use and privacy statements, such as the Entrepreneur’s Tool or the Professional Qualifications Recognition Tool. They also do not apply to services, activities, decisions, processing operations or procedures carried out by third parties, such as authorised business counters or other competent authorities, which are subject to their own terms of use and privacy statements.

If the User does not accept the content of these Terms of Use, the User is invited not to use the business.belgium website and to leave it.

2. Description

The business.belgium website constitutes the national Point of Single Contact enabling citizens, entrepreneurs and businesses to access, through the online platform, information, procedures and assistance services relating to the exercise of economic activities in Belgium.

It provides information relating to rights, obligations and rules applicable within the internal market, as well as to the administrative formalities necessary for starting and carrying out economic activities. It provides access to administrative procedures falling within the areas covered by Annex II of the SDG Regulation and offers assistance, support and guidance services aimed at facilitating the completion of administrative formalities.

The website also includes information relating to the formalities applicable to entrepreneurs, including legal requirements, authorisations, permits, licences and other obligations necessary for carrying out economic activities in Belgium.

In order to facilitate the completion of these formalities, the website provides access, through links, to digital tools or applications facilitating the submission, monitoring or transmission of administrative requests, such as the Entrepreneur’s Tool and the Professional Qualifications Recognition Tool.

In case of questions, the User may contact the competent services through a contact form.

3. Access to the Website

Access to the website is open, without authentication, to any natural person.

4. Role of FPS BOSA

FPS BOSA acts as the authority responsible for the development, technical management, operational coordination and maintenance of the website. In this context, it is responsible in particular for the generation and integration of the platform’s informational content, as well as for the centralisation of user feedback relating to the quality, accuracy or completeness of the information published. It also facilitates coordination between the various competent authorities, notably through the organisation of consultation bodies dedicated to the validation of content, and acts as an intermediary in the follow-up of exchanges with the European Commission concerning the quality of information. It does not exercise any decision-making power with regard to the creation of a business, the allocation of a company number or registration in the Crossroads Bank for Enterprises. Furthermore, it does not exercise any decision-making power in relation to the activities of the Professional Qualifications Recognition Tool.

FPS BOSA acts exclusively as a technical and administrative intermediary in the context of its mission as a federal service integrator, as provided for in the Act of 15 August 2012 establishing and organising a federal service integrator and in implementation of Article 16 of the Cooperation Agreement of 4 April 2024 between the Flemish Community, the Flemish Region, the French Community, the German-speaking Community, the Joint Community Commission, the French Community Commission, the Walloon Region, the Brussels-Capital Region and the Federal State on the intergovernmental implementation of Regulation (EU) 2018/1724 of the European Parliament and of the Council of 2 October 2018 establishing a single digital gateway to provide access to information, procedures and assistance and problem-solving services and amending Regulation (EU) No 1024/2012.

Questions of a technical nature relating to the operation of the website submitted by the User through the contact form are handled by the FPS BOSA service desk. Questions of another nature are forwarded by FPS BOSA to the appropriate contact points.

5. Role of the competent public authorities

The public authorities (federal and federated) are responsible for the provision, validation, quality and updating of the information falling within their respective competences and intended to be published on the informational content pages of the business.belgium website. For this purpose, they provide the necessary information concerning rights, obligations, applicable rules, administrative procedures, as well as assistance and problem-solving services.

They cooperate within the intergovernmental governance framework, in particular the SDG Team and the Content Coordination Group, which are responsible for generating content pages on the basis of the information provided, and they validate the content falling within their respective competences.

They ensure compliance with the quality requirements laid down in the SDG Regulation and maintain up-to-date data and metadata in the dedicated systems. They also process feedback relating to the quality of the information and make the necessary corrections within the applicable time limits.

6. Personal data

FPS BOSA respects the privacy of users. FPS BOSA processes personal data in the context of the website in accordance with the General Data Protection Regulation (GDPR). For more information, please consult the Privacy Statement.

7. Availability and continuity of the service

FPS BOSA makes every effort to ensure the availability and proper functioning of the business.belgium website, without however being able to guarantee uninterrupted availability. Temporary interruptions may occur, in particular for maintenance, security or technical reasons.

8. Liability

FPS BOSA and the public authorities make significant efforts to ensure that the data, messages and documents made available through the website are complete, correct, accurate and up to date. Despite these efforts, inaccuracies may nevertheless occur. If the data, messages or documents provided contain errors, or if certain information, messages or documents are unavailable, every effort will be made to correct the situation as quickly as possible. If you identify any inaccuracies in the data, messages or documents made available, you may contact the FPS BOSA service desk at any time.

FPS BOSA endeavours to secure the website by all reasonable means and to limit, as far as possible, any inconvenience resulting from technical errors. However, it cannot exclude the occurrence of erroneous technical manipulations or unauthorised interventions. For these reasons, FPS BOSA cannot guarantee that access to the website will not be interrupted or otherwise affected by such issues. In the event of technical difficulties, you may contact the FPS BOSA service desk at any time.

FPS BOSA expressly reserves the right to interrupt access to the website at any time and without prior notice in order to detect or prevent potential abuse or fraud, or to remedy technical or operational malfunctions.

Where FPS BOSA determines or may reasonably assume that the User is not complying with the conditions relating to the website, it may deny the User access to the website at any time.

FPS BOSA shall under no circumstances be held liable for any direct or indirect damage resulting from the use of the website or from the receipt or storage of the data, messages or documents made available.

9. Languages used

The website and all information falling under the responsibility of the federal authorities are made available in the three national languages as well as in English, in accordance with the obligations imposed by the SDG Regulation.

Certain information, documents or procedures made available through the website may fall under the responsibility of regional or local authorities or entities. These authorities or entities are subject to their own applicable language legislation and may therefore provide information only in the language or languages required or permitted under that legislation. Where applicable, it may be indicated which language version constitutes the authentic version and which version is provided as a non-authentic translation for information purposes.

10. Security

The User undertakes to use the business.belgium website in a lawful, fair and secure manner and not to compromise the integrity, availability or confidentiality of the systems and data.

Users are prohibited, whether intentionally or unintentionally, from using malicious software, introducing harmful programs or files (such as viruses), or carrying out any other act aimed at obtaining unauthorised access to the website, modifying its content or disrupting its services.

11. Modification of the Terms of Use

FPS BOSA reserves the right to amend these Terms of Use at any time. The applicable version is the version published on the website at the time of its use.

12. Applicable law and competent courts

These Terms of Use are governed by Belgian law. In the event of a dispute, the competent courts of Brussels shall have exclusive jurisdiction, without prejudice to any mandatory legal provisions.
